The gratuitous transfer and Petrodel: reform or no reform?
Stubbins, M. 2016. The gratuitous transfer and Petrodel: reform or no reform? Trusts & Trustees. 22 (5), pp. 516-524. https://doi.org/10.1093/tandt/ttv230
The gratuitous transfer of property has been a settled area of equity for many years, with different rules applying to personal property and land. The question asked, therefore, is whether or not Petrodel should be considered to have reformed the law relating to gratuitous transfers of land.
